The impunity of marital rape

Image
Source : https://indianexpress.com/ India is one of only 36 countries where this intimate assault is a perfectly legal crime. The law that shields marital rape must be urgently struck down. Written by Anirudh Pratap Singh “When a stranger does it, he doesn’t know me, I don’t know him. He’s not doing it to me as a person, personally. With your husband, it becomes personal. You say, this man knows me. He knows my feelings. He knows me intimately and then to do this to me – it’s such a personal abuse.” ‘License To Rape: Sexual Abuse Of Wives’ by D Finkelhor and K Yllo (1987) Criminal Justice Policy Review Domestic violence in India is an entrenched problem, and it has only been exacerbated in the recent years. About 70 per cent of women in India are victims of domestic violence. National Crime Records Bureau’s (NCRB) ‘Crime in India’ 2019 report was worrisome but not startling. As per the report, in India, a woman is raped every 16 minutes, and every four minutes, she experienc...

Rape conviction rate remains abysmal in India

Image
Source : https://theshillongtimes.com/ NEW DELHI:   Eight years after the Nirbhaya case of gang-rape and murder of a physiotherapy student shook the conscience of the nation and led to hanging of four rapists earlier this year, the conviction rate in rape cases still remains abysmal despite stringent anti-rape laws in place. As per the recent National Crime Records Bureau (NCRB) data, the conviction rate for rape cases remained at 27.8 per cent in 2019. Out of a total of 1,62,741 rape cases which went to trial in 2019, the court convicted people in only 4,640 cases. In 2018, however, the rate was 27.2 per cent, down from 32.2 per cent in 2017 and 23.9 per cent the year before that. According to legal experts, one of the reasons why criminals do not get convicted is poor investigation by the police, family pressure on victims, hostility of witnesses and complainants, absence of forensic labs and fast-track courts. Advocate Aparna Bhatt, former member of Delhi’s rape...

Four men charged with rape and murder of Dalit woman in India

Image
Four men have been charged with the gang-rape and murder of a 19-year-old Dalit woman in   India , a case that prompted nationwide protests and drew a fresh spotlight on India’s endemic problem of sexual violence. In September in Hathras, a small village in Uttar Pradesh, the 19-year-old woman was working in the fields when she was pounced on by four older men who dragged her to a field, attacked her and then tried to strangle her with her shawl. The charge sheet filed by the central bureau of investigation on Friday confirmed the girl was gang-raped and four men have been charged with her murder. The girl was a Dalit, India’s lowest caste, formerly known as “untouchables”, while her four alleged attackers were from a higher caste. Sexual violence against Dalit women is  regularly used as a tool of oppression  and around 10 Dalit women are raped every day in India. The 19-year-old was discovered by her family bleeding in the field, barely conscious and with her spi...

Death penalty no magic bullet to curb rape cases

Image
Source : https://www.tribuneindia.com/ Law enforcement officers and criminologists are of the view that the real deterrent against crime is certainty and not severity of punishment. Death penalty for rape will not curb this grave crime against women unless there is an improvement in the justice delivery system, removal of institutional prejudices against women, and gender sensitisation of society. Unfortunately, Indian society still remains steeped in a patriarchal culture. THE Maharashtra cabinet recently approved the draft of the Shakti Criminal Law Bill which provides for death penalty for serious offences such as rape and child abuse. The Andhra Pradesh government is also reportedly enacting a law containing a similar provision of death penalty for rape. This brings to the fore the question whether death penalty will act as a deterrent against growing incidence of rape in the country. Will the fear of death scare and deter the rapists? There is no doubt a surge in rape cases across...
